Arrogant government scumbaggery tries to shut down venerable oyster farm — UNacceptable, INtolerable!

In a dramatic injustice and prototypical example of political manipulation, the U.S. Department of Interior is trying to shut down the Drake's Bay Oyster farm so the "First marine wilderness in continental U.S." could be designated.

When I lived in Marin County in the late 1970s, I used to buy oysters there weekly, when it was known by the locals simply as "Charlie Johnson's oyster farm". Consequently, I am highly offended by, and vigorously resent, the political1 scumbaggery and lawlessness behind the closing of the oyster farm. This blog is my effort to hopefully do something about such government lawlessness, while simultaneously serving as something of a tutorial in showing people how to effectively fight government arrogance and lawlessness.

Now, at first glance, a naive, gullible and ignorant person who was operating under the delusion that government2 is the solution instead of the inevitable problem, my term "arrogant government2 scumbaggery3" might seem a bit extreme, a bit "over the top". Not so in the least. I know from first hand experience that many — (probably most, if the whole truth were to be admitted) — people in government2 would lie if the truth were funnier. That's the nature of the stupid-human game of politics1

When it comes to mechanics, deceptions and manipulations of inherently evil and inevitably corrupting One-Ring government2, I'm not all that interested in, or concerned about, the opinions of the combatively gullible, naive and ignorant. The fact remains that, as a pro se litigant, in the face of local lawyers and politicians insisting that I would lose, I confronted government2 law breakers and won a full blown federal trial with over 200 exhibits in the case of John R. Wilkenson v. U.S. Dept. of Interior, et al, 634 FS 1265 in the U.S. District Court for Colorado, the Honorable Richard P. Matsch presiding. (NOTE: In fairness, I must say that then-CNM-Chief-Ranger, Hank Schoch, affable father of author Lisa Schoch-Roberts told the truth in court. But the then-CNM-Superintendent, Dennis Huffman, lied under oath.) So I know a thing or two about federal government liars and the local politicians who support and enable them.

As it happens, Secretary of the Interior Ken Salazar, whose brother John is also a politician, is no stranger to controversy. You can read about his support and approval of the unpopular and (in my opinion) unreasonable decisions of CNM superintendents Lisa Eckert and Joan Anzelmo denying a bicycle race at the Colorado National Monument in various newspaper articles linked below. The government names and faces may have changed since my confrontation with the inherently evil and inevitably corrupting One-Ring of Power, but Ken Salazar and Jon Jarvis of oyster-farm-tyranny notoriety are apparently in the same cast of characters that denied the bicycle race at the Colorado National Monument, something that in my opinion, CNM founder, John Otto, a tireless enthusiastic CNM promoter, would have heartily approved and encouraged.

To find out what really happened in a case of this sort, I have found it extremely useful to read the court filings in the case. Two such documents I have linked here are an Ex Parte Petition for Temporary Restraining Order, and the Lunny's Complaint for Declaratory and Injunctive Relief.

I have every reason to believe Lunny's version of events regarding their oyster farm. In my case, President Ronald Reagan's Secretary of the Interior, James G. Watt, decided to try to illegally extract federal recreation fees from Glade Park ranchers and residents who engaged in non-recreational travel across a tiny corner of the Colorado National Monument solely for ingress and egress to and from their homes and the rest of the outside world. When I researched the legislative history of the relevant statutes and subsequent rules, I discovered that when at-the-time Secretary of the Interior, Stewart Udall was selling the proposed legislation to Congress, he said the "last thing in the world this legislation is intended to do" was exactly what the U.S. Dept. of Interior and National Park Service were trying to do with it!

My own bureaucratic horror story is much too long, complicated and distracting to go into here, but I thought it important to include a blurb so the reader can get some idea of what people go through when they get into a fight for survival against government arrogance and manipulativeness. Much of the most egregiously illegal and manipulative government behavior is inevitably sanitized out of the government's official version of events. In my case, it suffices to say various federal players were lying, various local players were lying, a local newspaper reporter was lying, and the Glade Park rancher who happened to be a county commissioner at the time, and was pivotal in getting the county commissioners to join my lawsuit, was deliberately financially destroyed in retribution by local political scum. A local bank partially owned and/or controlled by one of the more dominant political-mafia-scum types took advantage of corrupt Colorado law and the 1982 Exxon oil bust, "reassessed the equity position" on my friend's loans and called them immediately due, thus quite literally robbing him of both his Glade Park cattle ranch and his 20-plus-employee plumbing supplies shop — even though he had never missed, or even been late with, a single payment in his life. That, dear reader, is pure, unadulterated evil of the type which should not be allowed to remain unremedied in any free society.

I would plead with every person who reads this blog to do everything within his/her power to cause the Lundy family's story of gross injustice to be circulated as widely as possible via so-called "social media" and "citizen journalism". Remember Edmund Burke's famous admonition, "All that is necessary for the triumph of evil is that good men do nothing."

Always remember, "politics" = person or group A trying to persuade person or group B to obey the will of A, most frequently for the personal financial benefit of A and to the personal financial detriment (higher taxes) of B. 2. In reality, there is no such real thing as "government". It is not a rock, a tree, a river, or even a cloud. It is mere behavior, an established social order, a dominance-based pecking order. With other animal species, it is often called "dominance hierarchy". In the case of humans, the term "social hierarchy" is more often used. As Frédéric Bastiat said, "Government is the great fiction through which everybody endeavors to live at the expense of everybody else." As H.L. Mencken said, "Every election is a sort of advance auction sale of stolen goods." As General Smedley Butler has written, "War Is A Racket". In reality, "government" is merely the dominant individuals in the inherently evil and inevitably corrupting stupid-human pecking order struggle known as "politics"1. These disordered-by-definition dominant individuals merely call themselves "government" so the hoi polloi masses will view them as being intelligent enough and moral enough to follow and obey.

As I said in the "Welcome" section of this website, (it bears constant repetition): Regarding the words "scum" and "scumbag" as an epithet used in self-defensive demonization against select individuals. Hey, what can I say? It is a long-proven statistical fact that negative political ads work. And since the so-called "Left" uses lies, half-truths, demonization and the politics of personal destruction as standard political strategies, failure to engage in a little "turn about is fair play" merely makes it easier for the various assortments of disordered illiterate fascist control freaks to destroy individual freedom. As I said on my blog homepage, "Some folks just think they're smarter than everybody else, a higher form of life than everybody else. So, instead of engaging in good faith discussions about specific ideas, they simply resort to deception, sophistry, unspecificity, undefined terms, manipulation, demonization and the politics of personal destruction AS A MATTER OF PREFERRED STRATEGY to get their little spoiled-brat control-freak way. Such behavior is anathema to intellectual honesty, an open mind, a kind heart, free inquiry, the freedoms of thought and speech, and the free flow of information. It MUST be eternally warred against if humankind is to entertain a realistic hope of ever reaching its full spiritual and intellectual potential." To avoid the violence which is directly related to repression of free speech and the crushing of polite and civil discourse, I believe it is essential to engage in strategic tit-for-tat with wannabe-clever manipulative demonizers by openly calling them what they are: the anti-freedom, anti-Golden-Rule scum of the earth (aka "scumbags"). Accordingly, it doesn't bother me in the least to do so. No less brilliant a person than Jesus of Nazareth himself referred to the scumbags of his day as "hypocrites", "blind guides", "vipers" and "whitewashed sepulchres". To paraphrase Ann Coulter, Jesus was not some moron driving around in a Volvo with a "be nice to people" bumper sticker on it. So, having read The Art of Political War and Other Radical Pursuits by David Horowitz, I don't have any problem with calling reprobate, treasonous-to-the-U.S.-Constitution "scum" what it is.

4. In a healthy culture where intellectual honesty was held in high esteem, the American citizenry would tend to correctly view the U.S. Constitution as a legally binding specific-performance two-party contract, restricting federal government's power over the states and individuals. Such a contract is not open to unilateral change via deliberate, strategic misinterpretation by only one (the government) of the parties to the contract. That was the Founders' intent behind the 9th and 10th Amendments and Article V. That understanding was changed by John Marshall and a majority of the U.S. Supreme Court in the central-banks-friendly decision of M'Culloch v. Maryland, 17 U.S. (4 Wheaton) 316 (1819). No less a mind than Thomas Jefferson said that if the 10th Amendment meant what John Marshall and the M'Culloch majority said it meant, the states would never have ratified the Constitution

In stark, polar contrast, politicians and bureaucrats believe the Constitution means whatever they say it means, that federal government's power is limitless, and if enough people disagree, they can periodically vote offending politicians out of office. Neither government nor the so-called "mainstream media" (MSM) EVER talks about the life-and-death difference between these two opposing views of the social contract, the so-called "Supreme Law of the Land". The ugly unvarnished truth is that politicians and bureaucrats, despite swearing oaths to uphold the constitution, virtually all care absolutely nothing at all about the constitution. To them it is at best utterly irrelevant. It simply doesn't exist. Yet virtually all of them will cheerfully lie about that fact, while giving meaningless lip service to the social contract. That makes intellectually honest conversation and debate impossible, because, confident in their certainty that they are a higher, more intelligent form of life than you are, they are arrogantly denying doing the very thing they are actually doing. (Remember: in my case, the legislative history proved that "the very last thing" the relevant legislation was intended to do what what the Reagan administration was doing with it.) The huge majority of the general public who has never had a confrontation with government involving litigation is completely unaware of this political reality.

One of the most interesting things to me about the Great Oyster Controversy is the fact that anti-oyster-farm Ken Salazar and pro-oyster-farm Dianne Feinstein are both Democrats. It is crucial for any liberty-and-justice activist to understand that government injustice and manipulation are not a matter of political party or ideology. Both duopoly debt-as-money-oligarchy-serving parties, that is to say, both "Left" and "Right" are guilty of the same behavior. Only the agendas, names and faces change. The evil methodology of deception and manipulation are the same. Just because Feinstein finds herself on the side of liberty and justice in the Great Oyster Controversy doesn't mean she is not a tyrant-minded fascistic5 neofeudalist (my opinion) when it comes to the 2nd Amendment and the citizens undisputed right to self-defense and to bear arms. Regardless of the personal philosophy of any particular reader, as I said, Only the agendas, names and faces change in the inherently evil and inevitably corrupting "government2 game".

A brief word about citizen journalism. Technology has made it possible for one individual with a smart phone — who just happens to be in the right place at the right time — to make a video of cops beating somebody up and post that video on YouTube for the entire world to see — before the cops have even finished beating the person up. Now THAT is "real-time" news! THAT is how the average citizen can function as journalist and expose the lawless behavior of government operatives. Another technological factor is hyperlinking, which allows citizen bloggers to link videos, pictures, articles, and various types of files to their blogs, giving them a sort of vastly expanded footnoting capacity which, in turn, provides the reader with a far broader base of information. An example of what I'm talking about is the video titled, "How to make the police leave you alone", made by citizen journalist, Adam Kokesh. Observe how Adam coordinates his website, YouTube, Twitter, and Facebook to carry out the functions of citizen journalist. Another outstanding example of citizen journalism is "CopBlock" See how CopBlock uses their website, YouTube, Twitter, and Facebook to expose government wrong doing. These are only two — excellent ones to be sure — of many examples of powerful new alternative citizen media. Any interested person can acquire the necessary skills to do exactly the same thing.

Police absolutely hate being recorded because they want to be able to violate your constitutional rights with impunity, AND without the public being made aware of their lawlessness. It is common practice for them to lie and pretend that recording them constitutes the faux criminal offense of "interfering with an officer" or "obstructing an officer" or "threatening an officer". Fortunately, contrary to the self-serving opinions of more than a few bully/thug cops, courts, even federal courts of appeal, have ruled that recording the public behavior of cops (aka citizen journalism) is protected by the 1st Amendment.

The citizen journalist should never be unprepared or naive, or establishment propagandists, manipulators, spinners and demonizers will eat you alive. They will control the narrative and spin, and consequently, public opinion. Links to information are not good enough. Always make copies of all valuable information you find on the Internet, especially videos, and store them on your personal computer, hard drives, flash drives, CDs, DVDs, etc. Spread copies around with trusted friends. Stuff disappears from cyberspace all the time, as government manipulators secretly (and not so secretly) try to alter history itself to keep the "little people" ignorant, docile and obedient. Always remember that, as Machiavelli taught us, the most dangerous of all human activities is to try to change an established order. The dominant members of the stupid-human pecking-order struggle who like to call themselves "government" take a very dim view of any person who understands and opposes their elitist scumbaggery.

Lastly, the observant reader may have noticed the difference between quality of the pdf file of the Lunny's Ex Parte Petition for Temporary Restraining Order and their Complaint for Declaratory and Injunctive Relief. That is because the former file was only 225KB (kilobytes), while the latter was 14.5MB (megabytes). The bigger the file, the more difficult it is to put on your website. In the case of a larger file, while you may be able to download it to your computer for archiving, due to CMS (content management system) considerations, you may have to link to the original source as a practical matter. It seems just as dancers care nothing about the difficulty of a tune for the musicians, the typical news/information consumer cares nothing about the technical difficulties encountered in running an alternative news website.
