The killing of retired Navy veteran Lewis Pollard by the American police state

In a dramatic injustice, three policemen in Fruita, Colorado shot retired Navy veteran and U.S. Constitution lover, Lewis Pollard, age 61, dead. His crime? Daring to disagree with constitution-hating rogue government1.

It seems to this corner that Fruita police chief, Mark Angelo, once characterized by a former Fruita policeman as a “vindictive little bureaucrat”, per top-down federal police-state policy — (see e.g. "Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment", "FBI: Sovereign Citizens A Growing Domestic Threat to Law Enforcement", "DHS Says Gun Owners Are Terrorists", "West Point center cites dangers of ‘far right’ in U.S." etc) — has taken it upon himself to dehumanize and demonize Pollard as a "Sovereign Citizen" type in a transparent attempt to justify the unjust and unnecessary shooting in the eyes of the public under the propaganda lie, "see, he's a bad person, so he deserved it". Serious intellectual push back from the truth against such systemic deception seems both appropriate and necessary. Hence this blog.

The following news clip contains comments from Angelo and Pollard's daughter, Jolene Gifford. I hope she contacts the same Colorado ACLU lawyers who sued successfully on behalf of unjust shooting victim Jason Kemp's family. I also hope she doesn't let the government destroy crucial evidence by cremating her dad's body.

Family of Man Shot By Police Speaks Out

Sadly, the self-importance and false pride of too many people vastly exceed their factual knowledge, intellectual curiosity and common sense. There are some cutesy manipulators who attempt to demonize anyone who objects to unconstitutional government behavior, especially by police. This type of wannabe-clever scum3 inevitably resort to using sophistic emotional appeal to discuss the "who" — e.g. "you're an anarchist", "you hate law enforcement", "you hate cops", "you hate the military", "you're unpatriotic", "you hate freedom", "you hate the underprivileged", "you hate the poor", "you don't want to pay your fair share", "you don't care about the safety of our children", "you don't care about the environment", "you're a racist, bigot, misogynist, homophobe, hater", ad infinitum — of any political controversy instead of using provable facts to discuss the "what" (e.g. what are the specific facts, what is the specific law) of the issue in question. To those combatively stupid, rude and Constitution-101-illiterate types, I say: if you disagree with any particular part of the U.S. Constitution, then pursuant to Article V, you should do the necessary work to amend it in accordance with legal due process and the rule of law instead of just ignoring it, disobeying it, or deliberately misinterpreting it to fit your personal political/economic agenda/s.

Let's start right off with the truism that people tend to get the government they deserve. So if we are a bunch of Constitution-101-illiterate, Big-Brother-"educated", "freebie"-addicted, inbred, tatooed, nose-pronged, mouth-breathing, knuckle-dragging amoral degenerates who couldn't find the truth if it was our butt and we were using both hands, then we are going to get the full-blown police state we already provably have.

The problem with Angelo and all the other cutesy-pie scum3 who try to demonize the so-called "Sovereign Citizen" movement, is that the government actually does violate the U.S. Constitution, continually, routinely and deliberately. That's a FACT, conclusively proven and exhaustively documented beyond any shadow of doubt on this website to any intellectually honest person who is even remotely interested in truth, individual freedom, and honest conversation.

On this website, I like to make most of my points by using direct, on-point, in-accurate-context quotes from some of history's brightest and most famous people, including U.S. Supreme Court justices, constitutional scholars, etc, etc. I also like to use the technology of hyperlinking as a sort of electronic footnotes to document everything I say. So when you wannbe-clever destroyers, manipulators and trolls on the comment strings — you know who you are — want to make your pathetic too-dumb-to-live little comments, you are going up against the likes of Thomas Jefferson, Thomas Paine, Judge Andrew J. Napolitano, constitutional lawyer and author, Mark Levin, and a host of others. So I scoff at you. I ridicule you, and, having recognized that your mindless blitherings are actually part of the formulation of public opinion — an unfortunate phenomenon I find totally unacceptable — I have decided that some rhetorical tit-for-tat is politically necessary. Therefore I spit upon your lewd, rude, crude, too-dumb-to-live, proud-of-your-ignorance combative stupidity, manipulativeness and general Economics-101, Constitution-101 and Politics-101 illiteracy. The government provably DOES deliberately engage in unconstitutional behavior all the time. So the so-called "Sovereign Citizens" do in fact have legitimate constitutional grievances, whether or not they are able to articulate them with adequate polemic skill to be politically effective. Accordingly, I will not tolerate their demonization by such manipulators as Fruita Police Chief Mark Angelo and his supporters to go unopposed, either intellectually or politically.

Since the Daily Sentinel started publishing commentors' real names and disallowing pseudonyms, apparently in an ill-advised manipulation to censor content under the pretense of "increasing civility", the number of comments in their talk strings seems to have diminished quite substantially. So, for the purpose of this blog, I used two KREX stories (see HERE and HERE).

On the two KREX stories where I read the comment strings, the number of pro-Pollard comments was 28, while there were 21 anti-Pollard comments and 2 "neutral" comments. Two of the anti-Pollard commentors posted 5 times, and three of the pro-Pollard commentors posted 2 times, so a more accurate estimate of public opinion would be 25 pro-Pollard and 13 anti-Pollard. While the numbers are so small as to be statistically undependable, that still represents a public opinion of about 2 to 1 against the shooting. I have listed the rude, crude and illiterate anti-Pollard commentors in the footnote5 section below, and made an appropriate "tit-for-tat" response to each.

Of particular interest were two pro-Pollard posts. "Interested" wrote, "There's a judge who is very happy that Lewis is dead. His job will be easier. Lewis was in his courtroom often with illegal foreclosure cases and other legal matters helping victims for free. He went to Denver, Delta, and Montrose at his own expense to help other people. He was a member of the Colorado Republic not the Sovereign Citizen group. A dead man can't tell his side. You have to take the word of a three man team against the dead man. According to the constitution there are illegal actions taken in court concerning foreclosures and there are many illegal stops detaining drivers and abusing their constitutional rights to travel the highways without harassment. It's all over the internet. Millions of people cannot all be liers [sic]. Lewis was a monkey wrench in the legal proceeding of Mesa County. I would like to know the background experience of the three officers who shot Lewis. Perhaps CIA, Homeland Security, FTA, FBI. I wonder if 60 minutes would be interested?"

Obviously the police can be assumed to have been well aware of Mr. Pollard if he was a thorn in the local judiciary's side.

Also of particular interest was a post from "Bob Cunningham" who said, "Reasonable, prudent, objective law enforcement, this is what I was taught/trained at the police academy. Lew Pallard [sic] lived in Fruita many years, was a resident of Fruita, Colorado, he should have been known by the local police officers. This man was killed over a turn signal violation???? Give me a f*** break!! I as a street officer 12 years, bail bond agent/skip tracer 20 years, am proud of the record that no one was ever injured or killed in all this time! I understand Lew had prior warrants for minor traffic offences [sic], walked away from a traffic scene but did not pose any threat to anyone at this time. It is confusing and unclear to me from the reporting why these officers chose to return to his residence in the middle of the night! The reporting says that they knocked on his trailer but unclear as to whether or not they identified themselves as police officers. If someone was banging on the side of my house at that late hour of the night I too would appear with a weap[on]."

Now on with my analysis of what may have actually happened, based on the evidence of government lying which is contained in the various conflicting establishment news stories.

On June 16, Sentinel reporter, Charles Ashby wrote, "Three Fruita police officers fatally shot a man early Saturday during a traffic stop, but couldn’t confirm whether he was armed or explain why he was shot while allegedly running away from police." On June 17, Daily Sentinel reporter, Paul Shockley, wrote: "Law enforcement’s account of the incident has shifted since Saturday. Angelo told The Daily Sentinel on Saturday the suspect was shot while he was running away from his officers." In the same article, titled "Police: Man pointed gun at cops", Shockley also wrote, "Authorities declined to specify how many rounds were fired, or where Pollard was hit. Angelo declined to specify the type of handgun brandished by Pollard or confirm if it was loaded."

In the same June 17 story, Shockley quoted police (presumably Mark Angelo) as saying, "During the initial stop and the contact outside the residence with Pollard, he consistently made statements that were consistent to the ideology of those associated with the Sovereign Citizen movement who do not recognize established government entities." So, according to Angelo, Pollard "consistently" made statements "consistent" to ... but then Angelo won't say what Pollard's "consistently" made statments even were? Oh really? And that kind of dissimulative garbage is supposed to fly as being truthful? It doesn't even pass the smell test. Just how stupid does Angelo think the public and Sentinel reporters are? Maybe he thinks they're as stupid as the anti-Pollard commentors listed below in footnote 5 demonstrate they are. It's little wonder that Americans' confidence in newspapers continues to erode.

I believe evidence of the truth actually exists in the various conflicting news stories caused by the manipulative story changing (aka "inaccuracies") of Mark Angelo. Due to the recently unjustified killing of Jason Kemp by Colorado Highway Patrol officers, combined with all the media attention6 around that story, I believe Fruita police were terrified that they had another unjust shooting of an unarmed man on their hands, so they decided to lie and invent a cover-up story.

Why do I believe Pollard was (as was Jason Kemp) unarmed? Simple. The police originally told Daily Sentinel Charles Ashby that they "couldn’t confirm whether he [Pollard] was armed". That is ridiculous on its face. It's an easy fact to determine: you have a dead guy laying there — was there a gun in his hand or near his body? Yes or no? Let's use a little common sense here. As fond as police are of making strategic "leaks" to the media in an attempt to convict accused persons in the minds of the public prior to trial, if Pollard would have actually had a gun, that would have been the very first thing police would have told the media in an attempt to demonize Pollard and justify the shooting by making it look like they were just defending themselves. They didn't do that at the logically most opportune time, hence under the rule of "most logical, least logical", I believe it is most logical to presume that Pollard did not have a gun, all the too-dumb-to-live anti-Pollard commentors listed in footnote 5 notwithstanding.

Assuming arguendo for the moment Fruita police are lying, why won't they say what kind of gun they are alleging Pollard to have had in his possession? Easy. They know Pollard's family and friends probably know what kind of guns he had, so if they choose a make and model everyone knows Pollard didn't have, their lie would be exposed for all the world to see.

Why won't the police say where and how many times Pollard was struck by police bullets? Assuming for the sake of argument again Fruita police are lying, for them to admit which parts of Pollard's body the entrance and exit wounds appear on would more accurately determine whether he was shot in the back (as I believe most logical) or the front, or the sides, or all three. Knowing the location of the bullet wounds on Pollard's body would help either verify or contradict the police's latest version of the story. I pray to God Pollard's family does not allow the body to be cremated because, if the police are lying, they will put great pressure on the coroner to assist their cover up.

Keep in mind that if, as I believe to be most logical, the Fruita cops did shoot a fleeing unarmed man in the back, even though he was only wanted for minor traffic violations — at least Jason Kemp was suspected of a DUI violation — and in view of the fact Colorado settled with the ACLU and Kemp family for $1,000,000, and in view of the fact it very much appears as if Colorado's Attorney General has not improved the training of Colorado police officers, this time around, the ACLU might win a punitive award in the tens of millions of dollars. So, yes, there is substantial motivation for the Fruita police to lie.

Admittedly I was not there and don't pretend to know to a moral certainty what actually happened, but as I said, I truly believe evidence of the truth actually exists in the various conflicting news stories combined with the information gleaned from talk strings. Under the rule of "most logical, least logical", I believe an educated guess can be logically deduced as to what actually happened. I believe the first version of the police's report to the local media which clearly suggested that the then-unnamed man — I also believe the police already knew the identity of the man — who was shot by the police was unarmed and fleeing. That would mean he was most likely shot in the back, something the police refuse to tell us. I believe the Fruita police are now lying. I believe Mark Angelo should be fired immediately by the citizenry of Fruita.

It has already taken far too long for some of the most basic yet crucial facts to come out, such as the number and placement of entrance and exit wounds on Pollard's body. That fact alone creates an appearance that "authorities" are stalling for time to figure out what "spin" (aka lies) they want to use. The question is, are the Fruita police going to get away with what looks so very much like a bumbling, incompetent cover up? Are they going to get away with their withholding of so much crucial information? Are they going to get away with their total lack of transparency? Is the "fox-guarding-the-hen-house" multi-agency Critical Incident Response Team going to tell the truth, or double down on the cover up? Will the local media believe the cover up or keep digging for the truth?

These are all important questions which only time will answer.

(FULL DISCLOSURE: I am not a member or supporter of the Sovereign Citizen group. In fact, I consider their strategy pragmatically unwise and a self-generating problem even though, as a serious student of the U.S. Constitution and U.S. Supreme Court opinions, I know to a moral certainty some of their grievances against rogue government are constitutionally legitimate. Also, I did not know Lewis Pollard, nor am I a member of the Colorado Free State group he allegedly belonged to. As I said above, as a student of the the U.S. Constitution, I despise the kind of malevolent manipulative scum3 who, although they hate the U.S. Constitution themselves and cheerfully lie about that fact, attempt to demonize others as "haters" in a strategic attempt to influence public opinion in the direction of their unspoken agenda/s. It is their smarmy ilk who are the REAL haters. I can prove with documentation every word I say about the U.S. Constitution is true, while they don't even bother to try. They just call other people names, which is why over the years I have decided that "tit-for-tat" is necessary in their case.)

EPILOGUE:

Of course it was a foregone conclusion that the police-state apparatus would clear itself of accountability in an unnecessary shooting. It must be noted, however, that neither the story in the Daily Sentinel, nor the DA's letter (linked below) contained the crucial information as to the number and location of bullet entrance and exit wounds on Pollard's body. The body having already been cremated per the wishes of the decedent, the public apparently will never be allowed to know this information. Speaking only for myself, I believe such lack of transparency on the part of government's police power is a very dangerous "slippery slope".

Obviously, if Pollard had a gun and refused to drop it when so ordered by the police, the police were justified in shooting. If I were a cop, I would not wait until a perp raised his gun and started firing to find out if his gun was operable and he was a good shot. You defend yourself, it's as simple as that. And you are justified in defending yourself. Obviously, all professional police officers are keenly aware of that fact. That's why they would say from the outset that the perp had a gum.

In this situation, Fruita police chief, Mark Angelo, told the media at the outset police weren't sure whether the perp was armed or unarmed. He also said Pollard was shot while running away. Precisely because professional police officers would NEVER omit the fact that a perp had a gun when talking with the media, I believe Angelo was telling the truth the first time.

Any professional coroner's report would normally say exactly where the entrance and exit wounds were on the decedent's body, stating those specific facts in medically professional anatomical terms (e.g. occipital bone, parietal bone, etc), complete with numbers of centimeters indicating distances between wounds and specifically identifiable body parts. We've all watched enough police television dramas (e.g. Quincy, M.E.) to understand that. On the other hand coroners sometimes omit crucial information, citing "ongoing investigation" or some such lame excuse when the real reason is they don't want the public to have that information because they think the public will believe they fired too many rounds into the perps body, or otherwise did something wrong. Witness the recent case of Darrius J. Lowery-Baptiste in Madison, Wisconsin. I'll bet that, given the way things have gone in the instant case of Lewis Pollard, the coroner's report just happens to "accidentally" omit that information. Anybody want to bet?

I find that sort of lack of transparency entirely unacceptable.

"Confused": Yadayadayada. You try so very hard to appear "calm" and "reasonable" in a situation where lack of outrage is morally unacceptable. Open your eyes and grow up.
